B Illumitree LLC Terms and Conditions
By purchasing, renting, or using the services of B Illumitree, including but not limited to lighted Christmas tree manufacturing, sales, and installations, you agree to be bound by the following Terms and Conditions. Please read these terms carefully.
Section 1. Pre-Order & Deposit
1.1 / Pre-Order Requirement
To pre-order a lighted Christmas tree from B Illumitree, the customer must pay a non-refundable deposit of $50 per tree. This deposit secures an appointed installation date.
1.2 / Deduction of Deposit
The $50 deposit will be deducted from the total purchase price of the tree at the time of final payment.
1.3 / Final Payment
The remaining balance of the full price of the tree, including any applicable taxes, installation fees, and additional charges, must be paid in full prior to or on the installation date.
Section 2. Installation Date & Rescheduling
2.1 / Scheduled Installation
The installation date for the tree is chosen at the time of the order and is confirmed once the deposit is received.
2.2 / Rescheduling
If you need to reschedule your installation, you must contact B Illumitree by phone at least 24 hours prior to the scheduled installation date.
2.3 / Failure to Reschedule
If the customer fails to provide 24 hours’ notice or does not show up for the scheduled installation, the installation will be canceled, and no refund will be issued for the deposit.
2.4 / Travel Fee for Rescheduling
If rescheduling requires additional travel, a fee may be applied based on the new installation date and location.
Section 3. Cancellation & Refunds
3.1 / Cancellation Policy for Pre-Orders
If a customer wishes to cancel their pre-order, the customer will forfeit the $50 deposit and will lose the reserved installation date. No refund will be issued for the deposit.
3.2 / Refund Policy
All down payments, including the $50 deposit per tree, are final and non-refundable. No refunds will be issued under any circumstances except as outlined in Section 5.2.
3.3 / Final Sale
All purchases, including pre-orders and installations, are considered final upon payment in full and no further refunds will be granted.
Section 4. Leasing Agreement (For Rentals)
4.1 / Leasing Option
If the customer opts to rent a tree instead of purchasing, a separate leasing agreement must be signed prior to installation.
4.2 / Leasing Terms
The leasing agreement will outline rental duration, payment terms, responsibilities for damages, and any other applicable fees.
4.3 / Tree Return
The customer must return the tree at the end of the rental term, and any failure to do so will result in additional charges as defined in the leasing agreement.
Section 5. Damage and Warranty
5.1 / Damage (Warranty)
If a customer purchases a tree and it becomes defective under normal operations within the first Christmas season of ownership, B Illumitree will assess the damage and determine if repair or replacement is necessary.
5.2 / Replacement or Repair at No Charge
Repairs or replacements due to faulty equipment may be performed at no additional charge, but extra fees may apply if the damage was caused by the customer’s actions, animals or negligence.
5.3 / Customer Responsibility for Damage
Any damage caused by improper use, lack of maintenance, or vandalism is the responsibility of the customer, and repair or replacement may incur additional charges.
Section 6. Travel Fees
6.1 / Travel Fees for Installations
If the customer’s location is outside of a 20-mile radius from B Illumitree’s business location(Central Marion County or Ocala, FL), travel fees will be added to the final payment at the time of installation.
6.2 / Fee Calculation
Travel fees will be calculated based on distance and time required for travel to and from the installation site. This fee will be communicated to the customer prior to installation.
Section 7. Satisfaction Guarantee & Refunds
7.1 / Satisfaction Guarantee
If the customer is dissatisfied with the tree within 30 days of the installation date, B Illumitree will offer a refund of the full price paid for the tree, minus the deposit and any other applicable fees (e.g., installation, travel).
7.2 / Refund Processing
Refunds will be processed within 7-10 business days following a formal request from the customer, provided the tree is returned in the same condition it was installed.
Section 8. Limitation of Liability
8.1 / Exclusion of Liability
B Illumitree will not be liable for any indirect, incidental, or consequential damages arising from the purchase, rental, or installation of the lighted Christmas tree, including but not limited to damage to property or personal injury.
8.2 / Customer Responsibility
The customer agrees to take all necessary precautions to ensure the tree is safely installed and maintained, and that the installation area is cleared of obstacles and hazards.
8.3 / Force Majeure
B Illumitree will not be held liable for delays or failure to perform services due to circumstances beyond its control, including natural disasters, severe weather, or other unforeseen events.
Section 9. General Terms
9.1 / Agreement Changes
B Illumitree reserves the right to update or change these Terms and Conditions at any time. All changes will be communicated to the customer in writing, and any changes will apply to future orders and transactions.
9.2 / Severability
If any part of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions will remain in full effect.
9.3 / Governing Law
These Terms and Conditions will be governed by the laws of Florida, without regard to its conflict of law principles.
